AN ORDINANCE TO REGULATE BURNING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF TRENT WOODS: That it shall be unlawful for any person to burn anything outside of any business, residence, or other structure, or in or on any street right of way, lot, yard, or other property within the limits of the town of Trent Woods except as herein provided Burning shall be confined to private property, and absolutely no burning shall be conducted within any street or right of way. Burning shall be limited to bush, hedge, and tree branches, limbs and prunings; six (6) inches in diameter or less, pine straw; grass cuttings; underbrush; and other yard debris. Burning shall be limited to Tuesdays, Thursdays, and Saturdays between the hours of 8:00 a.m. and 10:00 p.m.; provided, however, that all burnings shall be initiated prior to 6:00 p.m., no additional materials shall be added to any burning subsequent to 6:00 p.m. on the day of burning; and all fires shall be fully extinguished with no smoke visible by no later then 10:00 p.m. on the day of burning. The provisions of this ordinance are not intended to and shall not make unlawful the burning of gas, charcoal, wood, paper, coal, or other combustible material in a grill, stove, or fireplace for cooking or for heating the interior of a business, residence, or other structure. Notwithstanding the above, to the extent that any federal or state law, rule, regulation, or other provision is or shall be more restrictive than as provided herein, the more restrictive provision shall control; provided, however, that a violation of the more restrictive provision which otherwise would not be a violation of this ordinance shall not be considered a violation of this ordinance for purposes of N.C.G.S. 14-4(a) or subject the offender to a fine as hereafter provided. Violations of this ordinance shall subject the offender to a warning for the first offense and to a fine of $25.00 for each subsequent offense.
