AN ORDINANCE TO REGULATE PARKING



BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF TRENT WOODS:



That, pursuant to authority set forth in NCGS 160A-301(a), it shall be unlawful for any person to park or leave standing a vehicle on the right of way of any public street within the Town at any location designated by the Town as a "No Parking Zone" as evidenced by (i) inclusion of such location on Exhibit A to this ordinance, and (ii) erection of "No Parking" signs at such location. Further, to the extent practicable, no portion of any vehicle parked within the right of way of any public street within the Town shall be left within the paved or main-traveled portion of such street; and in no event shall any vehicle be left unattended with any portion of such vehicle being within the paved or main-traveled portion of such street. Additionally, any law-enforcement officer shall have the right to require relocation of any vehicle which, in such officer's opinion, is parked or left standing in such a manner as to interfere with the regular flow of traffic or otherwise constitute a hazard.


As set forth in NCGS 20-161(d), the owner of any vehicle parked or left standing in violation of this ordinance shall be deemed to have appointed any investigating law-enforcement officer his agent:


(1) for the purpose of removing the vehicle to the shoulder of the street or to some other suitable place; and


(2) for the purpose of arranging for the transportation and safe storage of any vehicle which is interfering with the regular flow of traffic or which otherwise constitutes a hazard, in which case the officer shall be deemed a legal possessor of the vehicle within the meaning of NCGS 44A-2(d).


As provided in NCGS 14-4(b), violation of this ordinance shall be an infraction and shall subject the offender to pay a penalty of $50.00; provided, however, that pursuant to NCGS 160A-175(g), each day's continuing violation of this ordinance shall be a separate and distinct offense and shall subject the offender to pay a penalty for each day's violation.

This ordinance shall be effective upon adoption and is adopted this 5th day of August, 2004.
